Terms and Conditions


Usage of Epilepsy Action Australia's Online Academy and Community Training is offered subject to the following Terms and Conditions of use. Your continuance to book or purchase training courses will be interpreted as your acceptance of these Terms and Conditions.

Transfers and refunds

  • Transfer of course registrations between participants and refunds are only permitted upon written request to education@epilepsy.org.au prior to the commencement of the course. Epilepsy Action Australia reserves the right to refuse or accept the request at its sole discretion.

Payment terms

  • Payment for all courses, online or community training, is to be paid for prior to course attendance.
  • Individual registrations to online training can be settled by credit card at time of purchase.
  • Group registrations may be settled by invoice to your organisation, or by credit card over the phone by calling us on 1300 37 45 37. Invoices are due within 7 days of invoice date unless alternate arrangements have been agreed to in writing.

Online Courses

Course Expiry

  • Non-accredited courses are valid for 3 months from the date of registration.
  • Non-accredited courses can be reactivated within 9 months of registration date (6 months after expiry).
  • The reactivation fee is a $30 administrative fee plus $1 per course, reactivation will restart the 3-month validity period.
  • Non-accredited courses will need to be repurchased if past 9 months from registration date.
  • Accredited courses are valid for 12 months from the date of registration.
  • Accredited courses can be reactivated within 18 months of registration date (6 months after expiry).
  • The reactivation fee is $70, once per enrolment (provided there have been no changes to the qualification), reactivation will restart the 12-month validity period.
  • Accredited courses will need to be repurchased if past 15 months from registration date.

Practical Assessment Videos

  • The practical assessment video/s must be submitted within 3 months of the course theory component being completed (non-accredited courses). The course must be repurchased and restarted if these requirements are not met.
  • Students must have an active enrolment before submitting a practical assessment video.

Registration and Certificates

  • Once the course has been commenced, the name on the certificate/account cannot be changed to another person.
  • Epilepsy Action Australia’s Epilepsy Essentials (and authorised licenced copies) is a prerequisite for the Emergency Medications courses. Courses from other organisations cannot be recognised.

Facilitated Courses

  • Training commencement and finishing times are set at the time of booking; if the training commences late as a result of the paying organisation, then it is at the discretion of the trainer whether the training will run over the scheduled end time. Some content may not be able to be covered.
  • Where a training session is booked to commence outside of regular business hours Monday – Friday 6pm there will be an additional fee of $100
  • Participants who arrive more than 10 minutes after the scheduled commencement time will be ineligible to receive a certificate and may not be able to attend the remainder of the session.
  • Participant numbers are confirmed as part of the booking. Once the booking details and invoice are finalised, the invoice cannot be revised if anticipated participants did not attend.
  • If more participants attend the training than was booked for, an additional invoice will be issued for the difference in cost.

Cancellation Policy

Epilepsy Action Australia’s refund policy for trainer facilitated programs (face-to-face or via videoconference) is as follows:

  • When a training session is cancelled more than three weeks prior to the date of the course, the full fee will be refunded.
  • When a training session is cancelled less than three weeks but more than one week prior to the date of the course, then 50% of the fee shall be refunded.
  • When a training session is cancelled less than one week prior to the date of the course, then the full fee of the session will be retained by Epilepsy Action Australia.

Use of the Online Academy (https://academy.epilepsy.org,au) is subject to the following additional Site Policy agreement

Policy 8.1

The content on Epilepsy Action Australia's Online Academy website containing course materials compiled and provided by Epilepsy Action Australia, are owned by Epilepsy Action Australia, subject to copyright and other intellectual property rights under Australian and foreign laws.

The contents of this course are to be used for educational use only by the enrolled participants. It is provided to you for your information and instructional use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners.

All course material including videos, images, files, and all other content is provided for the sole use of the enrolled participants. Enrolled participants may view this information at anytime and anywhere during the enrolment period but they may not allow other people to view the course content. Course material may not, under any circumstances, be shown to an audience or projected for multiple people to view. It may not be distributed to other people or resource libraries at any time.

Only the original creator of the file is allowed to share and distribute the file to other parties and resource libraries.

Producing these courses is very complex and time-consuming work. We want to protect the content from being distributed illegally and unethically so we can protect the privacy of our clients and help to improve the understanding of epilepsy in a responsible and professional manner. Specifically, it is a violation of our terms of service to download the videos, or show the videos to anyone who is not enrolled in the same course.

1.1 I will not use this site for any form of commercial gain

1.2 I will not knowingly transmit software or any form of computer virus or file that contains a harmful component

1.3 I understand that any material published may be edited or deleted at the discretion of the administrators of this site

1.4 Plagiarism and/or cheating will not be tolerated and any participant found to be doing so will have access suspended until an investigation has taken place. NOTE: A violation of any of the above terms may result in immediate suspension or removal of access to this site.

2. Your Registration Obligations

In consideration of your use of the Online Academy service, you agree to:

2.1 Provide true, accurate, current and complete information about yourself as prompted by the registration/profile form

2.2 Maintain and promptly update registration data to keep it true, accurate, current, and complete. If you provide any information that is untrue, inaccurate, not current, or incomplete, or Epilepsy Action Online Academy has reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, Epilepsy Action Online Academy has the right to suspend or terminate your account and refuse any and all current or future access.

3. Member Accounts, Passwords, And Security

When you use Epilepsy Action Online Academy service, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. When you visit the Online Academy or send e-mails to us, you are communicating with us electronically. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

It is the responsibility of each user to keep all personal and contact information private. Under no circumstances will Epilepsy Action Online Academy be liable in any way for any personal information posted.

4. Member Conduct

You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages, or other materials, whether publicly posted or privately transmitted, are the sole responsibility of the person from which such content originated. This means that you, and not the Online Academy, are entirely responsible for all content that you post, e-mail, or otherwise transmit via the Online Academy. Under no circumstances will Epilepsy Action Online Academy be liable in any way for any content, including, but not limited to, for any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any content posted, e-mailed, or otherwise transmitted via the Online Academy.

You agree to not use Epilepsy Action Online Academy to:

4.1 Upload, post, e-mail or otherwise transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable;

4.2 Harm to minors in any way;

4.3 Impersonate any person or entity, including, but not limited to, an Online Academy staff member or forum leader, or falsely state or otherwise misrepresent your affiliation with a person or entity;

4.4 Forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the Online Academy;

4.5 Upload, post, e-mail or otherwise transmit any content that you do not have a right to transmit under any law such as inside information, proprietary and confidential information learned or disclosed as part of your relationship with Epilepsy Action Online Academy;

4.6 Upload, post, e-mail, or otherwise transmit any content that infringes any patent, trademark, copyright, or other proprietary rights of any party;

4.7 upload, post, e-mail, or otherwise transmit any unsolicited or unauthorised advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation that are designated for such purpose;

4.8 Upload, post, e-mail, or otherwise transmit any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment;

4.9 Interfere with or disrupt Epilepsy Action Online Academy server or networks connected to the Online Academy, or disobey any requirements, procedures, policies, or regulations of networks connected to Epilepsy Action Online Academy services;

4.10 Intentionally or unintentionally violate any applicable local, state, national, or international law, or any regulations having the force of law;

4.11 "Stalk" or otherwise harass another; or

4.12 Collect or store personal data about other users.

Epilepsy Action Online Academy has the right in their sole discretion to refuse or move any content that is available via the Online Academy and has the right to remove any content that violates Code of Conduct or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any content, including any reliance on the accuracy, completeness, or usefulness of such content.

You acknowledge and agree that Epilepsy Action Online Academy may preserve content and may also disclose content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the Code of Conduct; (c) respond to claims that any content violates the rights of third parties; or (d) protect the rights, property, or personal safety of the Online Academy, its users, and the public.

5. Public Content Posted to the Online Academy

With respect to all content you elect to post, upload, input, provide, or submit to the Online Academy, you grant the Online Academy the royalty-free, perpetual, irrevocable, non-exclusive, and fully sub-licensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed.

6. Indemnity

You agree to indemnify and hold EAA, its employees, officers, agents and contractors harmless from loss of any kind, including but not limited to:

i) Personal injury or death ii) Any loss of or damage to property iii) Any financial loss of EAA; iv) Any liability to or claims by a third party in respect of loss of or damage to property, financial loss or injury to or death of persons; and v) All legal costs and expenses incurred by EAA on a full indemnity basis caused directly or indirectly by, or arising out of, or in any way in connection with your act or omission (or that of your agent, employee or contractor) in your use of the Epilepsy Online Academy website or its services or any act or omission in any way in connection with the subject matter of this Agreement and whether the relevant act or omission constitutes a breach of contract, negligence or other tort, or breach of statutory or other duty or obligation.

The indemnity in this clause:

a) Is not the exclusive remedy of EAA, which may at its option, in addition or in

the alternative, pursue other remedies under this Agreement, at common law, in equity or under statute; b) Is a continuing indemnity; c) Survives termination of this Agreement and the cessation of the EAA Online Academy; d) Will not be affected by any matter including without limitation, the termination, renewal or extension of this Agreement or any indulgence, waiver or other concession given by a party unless the party benefiting from the indemnity agrees in writing; and e) Includes legal costs and disbursements on a full indemnity basis.

7. No Resale Of Service

You agree not to reproduce, duplicate, or copy any portion of the Online Academy content, materials or resources.

8. Modifications To Service

Epilepsy Action Online Academy reserves the right at any time to modify or discontinue, temporarily or permanently, the Online Academy service (or any part thereof), with or without notice. You agree that the Online Academy shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the service.

9. Termination

You agree that Epilepsy Action Online Academy in its sole discretion, may terminate your password, username, account (or any part thereof) or use of the Online Academy and remove and discard any content within the Online Academy for any reason, including, without limitation, for lack of use or if the Epilepsy Action Online Academy believes that you have violated or acted inconsistently with its policies. Further, you agree that Epilepsy Action Online Academy shall not be liable to you or any third party for any termination of your access to the Online Academy.
